Action Items

JULY 2001 BOARD MEETING

COMMUNICATION AND PUBLIC EDUCATION COMMITTEE

The board:

  • Reported on the revisions to the Notice to Consumers will be submitted to the graphic artist to develop the poster. Once the general layout is determined, then the wording of the regulation will be finalized and released for the 45-day comment period.
  • Reported that the printing of Health Notes #7 on Alternative Medicines was delayed to the new fiscal year because the Department of Finance reduced the board's deficiency request to prosecute its administrative cases at the Attorney General's Office. This action required the board to redirect funds from other sources in order to continue work by the Attorney General's Office.
  • Reported that it will soon release a request for proposal for the development, printing and distribution of Health Notes on Quality Assurance Programs.
  • Entered into an Interagency Agreement with the UCSF, School of Pharmacy for the development of Health Notes on geriatric medications, therapies, and issues.

LICENSING COMMITTEE

The board:

  • Voted to support the use of the North American Pharmacist Licensure Examination (NAPLEX) and a California Multi-State Pharmacy Jurisprudence examination to satisfy California's requirements for the professional licensing of pharmacists. Before the board can use the NAPLEX legislation must be enacted by the California legislature. For the board to support such legislation, it determined that Business and Professions Code section 4200 would have to be amended to accept the passing of the North American Licensure Examination (NAPLEX) and the California Multi-State Pharmacy Jurisprudence Examination on or after June 1, 2002. A new section would also have to be created to allow those applicants who have passed the NAPLEX exam after January 1, 1999, to be licensed in California. These individuals would be eligible for transfer of licensure to California if the individual has been licensed in good standing in another state for three years, has passed the California Multi-State Pharmacy Jurisprudence Exam on or after June 1, 2002 and completed 30 hours of CE during this same three year time period. Board support is also contingent upon the National Association of Boards of Pharmacy's (NABP) institution of an independent psychometric assessment of its exam every three years and performance of a job analysis every five years.
  • Approved the requests from Market Pharmacy, San Ysidro Health Center, Robinson Pharmacy, Mother Lode Drug Company and AIDS Health Care Foundation Pharmacies to deliver prescriptions to non-pharmacy locations for pick-up by patients at a later time.
  • Received a report on the June 8th meeting of the Pharmacy Manpower Task Force - a working group to ensure patient access to pharmacists' care and prescription services. The next meeting is scheduled for September 14, 2001, in Sacramento.

ENFORCEMENT COMMITTEE

The board:

  • Voted not to amend California Code of Regulations section 1717.3 to allow inpatient hospital pharmacies to include controlled substances on a preprinted, multiple check prescription blank. The proposal was requested by the Redding Medical Center.
  • Took no action on the proposals that were submitted to the Enforcement Committee during its March 2001 public meeting. The proposals included the recommendation that the board restores routine inspections - the board has already re-established its routine compliance inspection program. It was requested that a board subcommittee review all disciplinary actions prior to (filing an accusation) - the board did not agree that the added level of review by a board subcommittee was necessary in order to improve the board's efforts to protect the public. Another recommendation was that the board provides clear and complete documentation to support any claim for cost recovery - the board does provide a cost certification as required by law and additional documentation when it is requested. It was proposed that the discipline and terms of probation be imposed based on specific facts of the individual case - the board responded that it does impose discipline based on the facts of the individual case. When probation is imposed, the conditions are standard and when necessary tailored to specific cases by including the "optional" probationary conditions.

LEGISLATION/REGULATION COMMITTEE

The board:

  • Was advised that California Code of Regulations (CCR) section 1775, that expands the board's cite and fine authority, was approved by the Office of Administrative Law and became effective July 22, 2001.
  • Held an informational hearing on the proposed addition of CCR sections 1777-1777.5, which would implement the board's authority to cite and fine for violations of the Confidentiality of Medical Information Act. No comments were received.
  • Held an informational hearing to add CCR 1778-1778.3, which would implement the board's authority to cite and fine for inappropriate internet dispensing. No comments were received.
  • Accepted modifications to the proposed Quality Assurance regulations. The board adopted the Quality Assurance Regulations at its April meeting. Because the regulation language had been modified from the original version that was noticed, the board was required to notice the modified language for a 15-day comment period. Additional modifications to the regulation language were submitted during this 15-day comment period. The board accepted some of the modifications and finalized the regulation language. The final language will again be mailed out for a 15-day comment period.
  • Took positions on the following bills

  • Voted to support legislation that would increase the standards for pharmacies engaged in sterile compounding.
  • Approved the committee's strategic objectives for 2001/02.

ORGANIZATIONAL DEVELOPMENT COMMITTEE

The board:

  • Approved its Strategic Plan for 2001/02.
  • Performed an evaluation of its Executive Officer.
  • Reported that the Department of Finance reduced the board's request for a deficiency to prosecute its administrative cases. The board requested $400,000; however, the Department of Finance only approved $143,000. This required the board to delay the prosecution of some cases, cancel its order for new computer equipment and postpone the printing of Health Notes and The Script until the next fiscal year (which started July 1). The Legislature approved the deficiency request.
